Please read these Terms and Conditions carefully and ensure that you fully understand them before using our Services. By using the Services, you automatically agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, you should not use the Services or remain on ALVA MUSA’s Website. Continued use of the Website or placing orders will be considered as acceptance of these Terms and Conditions.

When we refer to “we”, “us”, “our”, “manufacturer” or “seller”, we refer to ALVA MUSA, a brand owned by CR Homes, Lda. When we refer to “you”, “your” or “buyer”, we refer to the person using the Services.

ENTIRE AGREEMENT

Acceptance of orders is expressly conditioned upon the buyer’s agreement with all terms and conditions contained herein. Acceptance of delivery by the buyer constitutes acceptance of these Terms and Conditions.

These Terms and Conditions represent the entire agreement between the parties. No additional terms, modifications, or amendments shall be binding unless previously approved in writing and signed by an authorized representative of CR Homes, Lda.

FORCE MAJEURE

All production and delivery dates are estimates only. ALVA MUSA shall not be liable for delays in production, shipment, or delivery due to force majeure or causes beyond the company’s reasonable control, including but not limited to: Government actions; Wars; Riots; Embargoes; Shortage of raw materials; Habor difficulties; Transportation delays; Fires; Floods; Accidents; Other manufacturing or shipping contingencies. Acceptance of goods by the buyer constitutes a waiver of any claim arising from delivery delays.

PRODUCT FEATURES

1. We reserve the right to discontinue products or change specifications without prior notice.
2. Many finishes are hand-applied and may vary in color, tone, and texture.
3. All images, dimensions, and descriptions are approximate.
4. Upholstered products may vary up to 5 cm due to the handmade production process.
5. Mattresses are not included with beds.
6. We do not guarantee resistance against fading of natural or dyed fabrics.
7. ALVA MUSA reserves the right to implement design improvements without prior notice.
8. Material colors may vary depending on the device used.
9. Lighting products include plugs and switches according to the destination country standards.
10. We do not supply light bulbs.
11. After order confirmation and payment, production depends on confirmation of fabric availability from suppliers.
12. When the client supplies their own fabric (COM – Client Own Material), production lead time only starts after receipt and confirmation of the material.
13. ALVA MUSA is not responsible for issues arising from fabrics supplied by the client.

PRODUCT CUSTOMIZATION

1. We can customize existing products or develop new products according to client specifications.
2. Design fees may apply for customized technical drawings or renderings.
3. Customized dimensions and finishes may imply additional costs.
4. Customized products may require extended lead times.
5. Customized orders are non-returnable.
6. Fabric quantities are calculated based on a standard width of 1.40 m.
7. We provide anti-stain fabric treatment services.
8. We provide fire-retardant fabric treatment services.
9. Fire-retardant interliner material may be applied between foam and fabric at an additional cost.

PRICES

1. Euro and Dollar price lists replace any previous versions.
2. All prices are EX-WORKS Portugal.
3. Standard packaging is included in the price.
4. We reserve the right to change prices without prior notice.
5. VAT is not included in the prices.
6. Changes to paid proforma invoices may be subject to administrative fees.
7. All taxes and duties shall be borne by the buyer.

SHIPPING POLICY

1. Transportation costs are not included in product prices.
2. When transportation is arranged by the client, ALVA MUSA assumes no responsibility for damages during transit.
3. When transportation is arranged by us, the client must inspect the goods upon delivery.
4. Delivery service includes door-to-door drop-off only.
5. Additional services may imply additional charges.
6. Export documentation fees may apply for shipments outside Europe.

STORAGE & STOCK

Storage fees up to 10% of the total invoice value per week may apply if payment is not completed or shipping arrangements are not made within the established deadline.

PACKAGING

Standard packaging is included in the price. Special packaging requests may incur additional charges.

CLAIMS AND RETURNS

1. Any claim must be submitted in writing within 48 hours after receipt of the goods.
2. Claims must include photographic evidence.
3. Upon confirmation of defect, we undertake to replace the defective item.
4. Customized products are not eligible for return.

CUSTOMER ACCOUNTS

Customer accounts will only be created after issuance of the first proforma invoice. Clients must provide valid company and tax information.

PAYMENT CONDITIONS

1. Standard Product: 50% upon order confirmation + 50% before shipment.
2. Customized Product: 50% upon order confirmation + 50% before shipment.
3. Production only begins after payment confirmation.
4. Payments must be made via bank transfer.
5. Remaining balance must be settled up to 3 days before shipment.
6. All products remain property of CR Homes, Lda until full payment is received.
7. Payments are non-refundable.

LEAD TIMES

1. Between 8 to 12 weeks + additional time for customizations + shipping.
2. ALVA MUSA is not responsible for delays caused by missing payment confirmations.
3. COM/COL orders only enter production after material receipt.
4. Raw material shortages may affect standard lead times.

COPYRIGHTS

Dealers may not use ALVA MUSA images, logos, or branded content without prior written authorization. All rights reserved. No part of our products or designs may be reproduced without prior written authorization.
